Terms of Service

These Terms of Service (“Terms”) govern all rentals and services provided by Miami Valley Party Rentals, LLC (“Company,” “we,” “our,” “us”). By booking, paying for, or using our rental items or services, the customer (“Customer,” “you,” “your”) agrees to be bound by these Terms.


1. Reservations & Payments

  • A 25% non-refundable deposit and an electronically signed rental agreement are required to reserve items.

  • The remaining balance must be paid in full one (1) day prior to delivery or pickup.

  • Orders not paid in full by the deadline may be considered canceled and subject to cancellation fees.

  • Quotes are valid for 30 days and subject to change.


2. Delivery & Pickup

  • Delivery requires a minimum order subtotal of $75 (before tax and fees).

  • Standard delivery includes drop-off the day before your event and pickup the day after. Weekend rentals are typically Friday–Monday.

  • Customer pickup is by appointment only and requires a valid state-issued ID.

  • Customer must ensure clear, safe, and accessible areas for delivery, setup, and retrieval. Additional fees apply for stairs, long distances, after-hours, or exact-time requests.


3. Cancellations & Refunds

  • Deposits are non-refundable.

  • Refund Schedule (minus deposit and processing/administrative fees):

    • 15+ days before event: Full refund minus deposit/fees

    • 7–14 days: 50% refund minus deposit/fees

    • 3–6 days: 25% refund minus deposit/fees

    • Less than 3 days: No refund

  • Store credit valid for 12 months may be issued in certain cases; it is non-transferable and not redeemable for cash.

  • Refunds will only be issued to the original payment method.

  • Weather-related cancellations (tents only): Refunds or store credit will only be issued if Company cancels due to unsafe conditions (winds exceeding 25 mph, flooding, or severe weather warnings).

  • Public health/emergency events: No refunds will be issued; store credit valid for 12 months will apply.


4. Equipment Care & Use

  • Customer assumes responsibility for all rental property from delivery/pickup until return.

  • Rental items must be protected from theft, weather, fire, misuse, and damage.

  • Items must not be subleased, resold, altered, or used for unlawful purposes.

  • Equipment must be used only as intended (e.g., no standing on chairs, no attaching objects to tents).

  • Customer must discontinue use of any unsafe equipment and notify Company immediately.


5. Tent Installations

  • Tents must be installed on a flat, clear, and accessible site with 5 feet of clearance on all sides.

  • 811 will be called to mark public utilities; Customer must mark all private utilities (sprinkler systems, pet fences, septic lines, etc.).

  • Once installed, tents may not be moved, altered, or dismantled by Customer.

  • Company may postpone or remove tents due to unsafe weather (e.g., high winds, lightning, flooding). Safety is the top priority.


6. Damage Waiver & Fees

  • A mandatory 10% rental protection fee applies to all orders.

  • Covers accidental/weather-related damage only; does not cover negligence, abuse, or loss.

  • Excessive cleaning fee: starts at $50.

  • Replacement: full replacement cost for lost or irreparably damaged items.

  • Re-delivery fee for missed/rescheduled deliveries: $100.


7. Liability & Risk Acknowledgement

  • Customer acknowledges that use of rental equipment involves inherent risks, including but not limited to injury, accidents, or property damage.

  • Customer assumes all responsibility for such risks.

  • Customer agrees to indemnify, defend, and hold harmless Miami Valley Party Rentals, LLC, its owners, employees, and agents from any claims, damages, or losses arising from use of rented items.

  • Company is not liable for damage to landscaping, underground utilities, or property not disclosed by Customer.


8. Privacy & Communications

  • We collect personal information (name, email, phone, address, payment details) to process orders and provide customer support.

  • Transactional Communications: By booking, you consent to receive emails and SMS updates necessary to process your rental (quotes, confirmations, delivery updates, pickup reminders).

  • Promotional Communications: With your consent, we may also send occasional promotional emails, offers, or updates. You may unsubscribe from promotional emails at any time by clicking the unsubscribe link, or from marketing texts by replying STOP. Transactional communications will continue regardless of marketing preferences.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles. Any dispute, claim, or proceeding arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in Montgomery County, Ohio, and Customer consents to the jurisdiction and venue of such courts.


10. Entire Agreement

These Terms, together with our Rental Contract Agreement, Privacy Policy, and SMS & Communications Policy (incorporated by reference at www.miamivalleypartyrentals.com/policies, constitute the entire agreement between the parties and supersede all prior understandings.


11. Electronic Signature

Electronic acceptance, including checkboxes or digital signatures through our booking system, shall be deemed valid and enforceable.
